Photoshoot Terms and Conditions

These Terms and Conditions ("Terms") apply to all photoshoot events, workshops, and production sessions organized by Phosmora ("Phosmora," "we," "our," or "us").

By registering for, paying for, or attending a Phosmora event, or by using the Phosmora platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. Phosmora reserves the right to change these Terms & Conditions at any time, and we will provide reasonable notice to you if this occurs.

1. Our Mission

At Phosmora, our mission is to create an inclusive, collaborative network that empowers artists of all skill levels and backgrounds. We are dedicated to fostering a creative community where individuals can connect, share knowledge, and elevate their artistic journeys. By organizing affordable events and providing the resources needed to nurture talent, we aim to inspire artists to reach their full potential and take their portfolios to new heights. Through support, collaboration, and innovation, Phosmora strives to be the catalyst for artistic growth and creative exploration.

Important Reminder: We ask everyone to approach this group with an open mind and a relaxed attitude. The main purpose of our community is to give artists the opportunity to learn from one another, share their passion, have fun, and improve their skills to become better creators. Everyone joins Phosmora for different reasons—whatever yours may be, make that your focus and enjoy the process of learning and growing. Just have fun and keep learning!

2. Event Participation & Requirements

By attending a Phosmora photography event, participants agree to:

  • Comply with all event rules set by the organizer, including safety measures and professional conduct requirements.
  • Follow all local laws and regulations applicable in New York, including those related to photography permits in public or private spaces.
  • Respect other participants’ privacy and refrain from offensive, intrusive, or disruptive behavior.

Age Restrictions & Teenager Participation

  • Participants must generally be 18 years of age or older to attend independently.
  • Teenagers are permitted to join Phosmora events under strict conditions: They must be accompanied by a parent or legal guardian and must provide written parental permission.
  • Each parent wishing to have their child participate must completely fill out the Permission Slip for Phosmora Events (available on our website) and submit it back to info@phosmora.com prior to the event.

3. Code of Conduct & Safe Environment

Phosmora will not tolerate disrespectful behavior, harassment, discrimination, or disruptive conduct of any kind. This includes, but is not limited to, the raising of one's voice toward another individual, bullying, intimidation, physical or verbal abuse, threatening behavior, offensive language, or unwanted physical contact.

  • Consent: Respect the privacy of other participants. Attendees must ask for explicit consent before photographing or recording individuals outside the scheduled event photoshoot activities.
  • Enforcement: Any participant who violates this Code of Conduct may be immediately removed from the event venue without a refund and may be permanently prohibited from attending future Phosmora events.

4. Photography, Video Usage & Copyright

Media Rights & Promotional Licensing

By attending a Phosmora event, you grant the event organizers permission to use any photographs or video recordings taken during the event for promotional, educational, editorial, or commercial purposes without financial compensation or prior notice. You acknowledge that any images featuring your likeness may be used in social media posts, advertisements, website content, or printed materials.

Copyright Ownership

  • The copyright of all photos remains strictly with the photographer who captured the images.
  • The photographer asserts the right to be credited as the author of their respective photos.
  • Any unauthorized reproduction or modification of event images by outside parties constitutes a breach of copyright.
  • Photographers may, at their discretion, share sneak peeks of the photos or provide digital proofs to participants for viewing.

5. On-Set Creative Roles & Responsibilities

Photographer Responsibilities

  • Image Delivery: All participating photographers must deliver at least three (3) edited pictures to each model and featured artist within two (2) months following the event. The platform and method used to share these images are at the sole discretion of the photographer.
  • Flickr Platform: Phosmora utilizes Flickr as a primary platform for compiling and sharing event imagery; however, photographers remain free to share the models' pictures through whichever delivery method they prefer.
  • Delivery Follow-Up: Models who have not received their images after the two-month deadline may reach out to Phosmora customer service. Phosmora will actively contact and solicit the delinquent photographers, though Phosmora cannot legally guarantee final delivery.

Models, Stylists, and Makeup Artists (MUAs)

  • Makeup Artists: Photographers are highly encouraged to emphasize, highlight, and showcase the detailed work of makeup artists within their close-up and portrait captures.
  • Stylists: Wardrobe stylists retain absolute creative authority over which models wear their curated clothing lines. Depending on the stylist's preferences and direction, some models may be requested to bring additional personal clothing items.
  • Image Publications: Models must request explicit permission from the photographer before submitting or using event images for formal commercial publications, paid advertisements, or magazines.

Technical & Aesthetic Special Requests

  • While photographers will professionally shortlist and edit portraits for your viewing, it is not always possible to digitally remove physical blemishes such as mucus, snot, or sleep crusts.
  • Attendees are expected to fix these personal presentation details beforehand. Please ensure your appearance, wardrobe, and makeup look exactly as intended before the photographers begin capturing images.

6. Mood Boards & Creative Direction

  • Phosmora establishes a distinct creative concept or mood board for each event, which is shared directly via the event booking link.
  • Organizers use these mood boards to guide artists on specific makeup aesthetics and advise stylists and models on requested wardrobe looks.
  • Participants are welcome to suggest future mood board concepts by emailing their ideas to info@phosmora.com.

7. Fees, Pricing & Logistics

Event Fees Allocation

Every registered participant pays a set registration fee. This fee directly funds event organization logistics, studio space rentals, catering/refreshments, and the liability insurance required to protect Phosmora and its participants.

  • Studio Variances: Fees for renting production spaces vary based on studio dimensions, location, and the specialized equipment included.
  • Summer Events: If a photoshoot is hosted completely outdoors during summer, participants will only be charged the base organizational fee, and no studio rental fee will apply.

Equipment Policy

  • It is recommended and expected that you bring your own cameras, lenses, memory cards, batteries, and necessary photographic gear.
  • While studio venues provide photography spaces and may offer limited support equipment, the organizers are not responsible for any personal gear.
  • Camera Donations: Photographers with functioning, unused camera equipment are encouraged to donate their gear to Phosmora. Donated equipment will be safely designated for use by aspiring creators who cannot afford their own professional gear.

8. Payment, Cancellation & Refund Policy

  • Non-Refundable Deposit: A non-refundable deposit is required at the time of registration to successfully secure your attendance slot.
  • Full Payment: Final balances must be paid in full at least fourteen (14) days prior to the scheduled event date.
  • Participant Cancellations:
    • If you cancel your reservation more than 14 days before the event, a refund of 50% of the total fee will be issued.
    • Cancellations made less than 14 days prior to the event date are completely non-refundable.
  • Phosmora Cancellations: The event organizers reserve the right to cancel or reschedule an event due to unforeseen circumstances (e.g., severe weather, venue emergencies). In these instances, participants will be notified immediately and issued a full refund or offered alternative transfer arrangements.
  • Accepted Payment Methods: Phosmora securely accepts payments via credit/debit cards processed through Stripe, as well as via Venmo.

9. Health, Safety, & Liability Waiver

Health Precautions

All indoor sessions are organized to maintain safety precautions wherever practical, including:

  • Provision of masks if locally recommended or required.
  • Maintaining appropriate social distancing on set.
  • Sickness Policy: Any participant experiencing symptoms of illness must not attend the event for any reason. Phosmora reserves the right to ask any sick participant to leave the venue immediately in the event of constant sneezing or coughing.

Food Allergies

Phosmora provides light snacks and beverages at events. However, Phosmora is not responsible for tracking individual dietary restrictions, food allergies, or ingredient intolerances. Participants must manage their own consumption safely.

Accessibility

Phosmora proudly welcomes participants with disabilities. Event organizers will review site logistics beforehand to ensure reasonable accessibility for disabled participants.

Liability Waiver & Indemnity Agreement

  • Assumption of Risk: You agree that the event organizers are not liable for any personal injury, loss, or property damage incurred during your participation. You voluntarily assume all risks associated with attending, including physical injury or equipment damage resulting from a lack of personal attention or environmental hazards.
  • Indemnity: All participants must sign a comprehensive indemnity agreement prior to session entry to confirm their understanding of these inherent production risks.

10. Platform Terms of Use & Disclaimers

Intermediary Role

The Phosmora platform acts solely as a digital intermediary to connect photographers, models, stylists, makeup artists, and creative customers. We do not participate in, dictate, or control the real-world interactions, secondary payments, private agreements, or off-platform services between individual artists and clients.

  • All creators and customers are solely responsible for resolving disputes directly with one another.
  • In the event of an unresolvable dispute, parties may request assistance. Phosmora is willing to evaluate the situation and provide mediation support entirely at its own discretion, without any formal or legal obligation to do so.

11. Reporting & Moderation Systems

Flagging Inappropriate Content or Behavior

Users have the right to flag content or behavioral issues that violate our community guidelines or these Terms. Flagging reports may be submitted through our website's reporting system for reasons including:

  • Harassment or bullying
  • Inappropriate language or offensive content
  • Spam or misleading information
  • Violations of intellectual property or copyright rights
  • Fraudulent, deceptive, or unsafe practices

The Review Process

  1. Submission: The user submits a confidential report through the website's flagging system.
  2. Review: Our internal moderation team reviews the incident and details secretly.
  3. Action: If a violation is confirmed, the moderation team will determine the appropriate response. This may include the modification/removal of content, warnings, temporary account suspension, or permanent banishment from the website and future physical events.
  4. Timeline: The moderation team aims to review submitted reports in a timely manner.
  5. Abuse of System: Submitting false reports or intentionally abusing the flagging system without cause is strictly prohibited and may result in penalties, including immediate account suspension.

Confidentiality & Appeals

  • Flagging reports are strictly confidential and are shared exclusively with active moderation personnel. The flagged user will not be informed of who submitted the report.
  • If a user believes their content or account was unfairly penalized, they may submit an appeal to customer support for a final administrative review.

12. Data Privacy & Information Sharing

  • Consent to Share: By signing up for Phosmora events, participants agree to share their name, email address, and social media information.
  • Collaboration Purposes: This data may be shared with other confirmed event participants solely to facilitate legitimate artistic collaboration, image sharing, and professional networking.
  • No Third-Party Sales: Phosmora will never sell, lease, or distribute your personal information to third-party marketing companies.
