Terms & Conditions
These Terms and Conditions will apply to each Phosmora photoshoot events. Phosmora is happy to answer to any questions or concerns you may have in relation to these T&Cs at any time.
However, signing for the photoshoot events and paying for it means you are agreeing with these terms.
We reserve the right to change these Terms & Conditions at any time, and we will give reasonable notice to you if this happens.

Important
Please, don’t take anything personal or too serious in this group.
The main purpose of the group is to learn from each other, have fun, share our passion and improve ourselves to become better artists and creators. Everyone joins the group for different reason so make that reason your main goal and try to have fun during the process.
We will not tolerate any disrespectful behaviour (including raising of voice towards someone, and/or harassment of any kind) at a photoshoot event or on the facebook group. Let’s be patient and kind to each other and if something doesn’t work, we learn from it and we’ll improve it along the way but there is no need to be frustrating or being too harsh or unkind. Also, before asking a question to the organizer, please make sure you have read announcements on the Facebook group so we avoid to repeat the same things again.

Mission
Phosmora has inspirations of involving artists to reach their full potential and take their portfolio onto another level.
Phosmora is a new platform that focuses mainly on organizing affordable events for all artists and helping people to grow artistically.
Also, because we think that skilled artists deserve to get paid as well and start being rewarded for their work we created a page where there are going to be posted only reliable and paid jobs for all artists wherever people are looking for models, muas, stylists or photographers.

Phosmora’s roles
Phosmora is a new platform that connects artists in NY, providing them new opportunities and also organize photoshoot events where everyone can grow and have fun. Phosmora will make sure everyone will have a great experience at the photoshoot events. Phosmora also has created a page where everyone (amateurs and pro) can upload, share their profile and their portfolio;

Behavior during the Photoshoot events
We will not tolerate any disrespectful behaviour (including raising of voice towards someone, and/or harassment of any kind) at a photoshoot event or on the facebook group.
The organizers are allowed to remove any participants at the event who is disrespectful toward the others.

Vaccinations
All sessions indoor will be planned to maintain, wherever possible, the following additional precautions:

  • Show proof of vaccination;
  • No unnecessary physical contact (e.g. handshaking);

Membership
Monthly membership fees are $4.50 to sign into Phosmora website, to get updates about upcoming photoshoot events and also to join the Artists profile;
6 months fees are $27.00.
1 year fees are $54.00

Members Account
You must register an account to access and use the Artists profile page and upload your profile to get more visibility.
Registration is only permitted for legal entities, partnerships and natural persons who are 18 years old or older. You represent and warrant that you are not a person or entity barred from using Phosmora platform under the laws of the United States, your place of residence, or any other applicable jurisdiction.
You must provide accurate, current, and complete information during registration and keep your account information up-to-date.
You may not register more than one account or transfer your account to someone else.
You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party.
You are responsible and liable for activities conducted through your account and must immediately notify Phosmora if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised.
If and as permitted by applicable law, we may, but have no obligation to ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.
Registration on Phosmora website will help you also to receive emails as a reminder of upcoming Phosmora events;

Fees for joining the Photoshoot events
Only photographers will pay a fee for the organization and for the people who organize the photoshoot events;
The total fees for the organization (which included website fees – organizer fees – snacks and no alcoholic drinks) will be $17.60 for big events plus the studio fees if the event will be in a studio and $13.60 for small events;
Fees to rent a studio can be between $9 to $80 per person depending in which studio the organizer will choose to organize the photoshoot event;
Also, to cover everyone in case of an accident at the studio, the organizer will need to ask money for the insurance at the studio so everyone will be covered in case of any incidents.

Resolving Damage Claims
Phosmora and the organizers won’t be responsibile if any attendants won’t pay attention and will get injured somehow at the event. Although a participant of the photoshoot event can provide valid evidence (photos or videos) that he/her got damaged at the event, the complaining participant can notify Phosmora and/or seek compensation through the Resolution Center.
The organizer will be also notified of the Damage Claim and given an opportunity to respond. If Phosmora states that the Damage Claim is valid, the organizer will be notified and will get a bad feedbak due to the lack of attention during the photoshoot event and the person damaged will be refund through insurance policy.
You agree to cooperate in good faith, provide any information Phosmora requests, execute documents, and take further reasonable action, in connection with Damage Claims, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services.

Organizers of the Photoshoot events
There are 3 organizers who will organize the photoshoot events.
There are going to be in total 3 photoshoots per month. Each Photoshoot events usually last between 4 to 6 hours;

Photoshoots events for brands
Phosmora will organize photoshoots events for any brand who need to sponsor their products.
Phosmora  organizer will find the model, photographer and the studio for the photoshoot.
Phosmora will charge for the following standard fees:

  • Photographer fees
  • Model fees
  • Organizer fees(fixed price)
  • Studio fees(varies depending on which studio the organizer will choose or if the photoshoot will be outdoor)
  • Phosmora fees

Photoshoots events for brands
Phosmora will organize photoshoots events for any brand who need to sponsor their products.
Phosmora  organizer will find the model, photographer and the studio for the photoshoot.
Phosmora will charge for the following standard fees:

  • Photographer fees
  • Model fees
  • Organizer fees(fixed price)
  • Studio fees(varies depending on which studio the organizer will choose or if the photoshoot will be outdoor)
  • Phosmora service percentage (10%)

Organizers Responsibilities
Each organizer is required to organize at least one event per month; The organizers will be responsible for providing all details about the event to the participants through Phosmora website;
The organizers will be responsible for managing the group during the events and guide not only the photographers, but also models, stylists and muas if they ask for advices; The organizers will be responsible to share the website in different groups on Facebook to get more visibility of the event;
The organizers will be responsible for keeping people engaged during the photoshoot event; The organizers will be responsible for creating the groups and pairing experienced photographers with amateurs photographers;
The organizers will be responsible for planning the right rotations of the photographers and models during the Photoshoots;
The organizers will be responsible for making sure everyone will have a respectful behavior at the photoshoot event following also the organizer’s plan; The organizers will be responsible to find a substitute if a participant won’t be able to make it; The organizer will be responsible to choose moodboard for the event, give direction to the muas about the makeup and give direction and advices to stylists and models; about the look requested for the event;
The organizers will have to organize events with minimum 10 people and not less than that; The organizer will be responsible for answering any questions from the participants about the event they organized within 24h;
The organizers will be responsible for uploading pictures on Phosmora IG about the events they organized;
The organizers will be responsible if organizing the events in public areas to get informed about regulations on a specific location;
After each event the participants will leave a feedback about the whole event through the website and if people are not happy with a specific organizer more than twice, then Phosmora will change organizer within one week notice;
Organizers at the beginning of each event will need to remind the general Phosmora rules to everyone;
Organizers, sometimes, will be able to organize photoshoot events for brands or businesses who require models, stylists, photographers or muas;
Organizers will have the authority to ask a participant to leave the photoshoot event in case of disrespectful behaviour toward the other participants more than once; Organizers will need to chase photographers of the event that after a month still didn’t share pictures on Flickr or in private with the models;

Photography Teacher
The Photography teacher will do 20 minutes presentation before the photoshoot about a photography topic that can help and improve the photographers skills.
The Photography teacher will always decides the topic but any photographer can advice it also sending an email to the organizer of that specific event;

Models
Models will not be able to see the pictures from the photographers before editing unless the photographer is willing to do that; Models, most of the time, will need to bring their own clothes according to the Moodboard decided by the organizer; Models need to come with the makeup on unless the organizer finds a makeup artists for the photoshoot;
Models can advise photographers any pose they want to try; Models can share on their social media only the pictures they like. They cannot be forced to share a picture they don’t like; Models are asked to tag the photographers on pictures they share on their social media so they can give visibility to the photographers as well; Models who will wear the stylist’s clothes will need to come prepared and with the right underwear at the photoshoot otherwise it won’t be possible to wear the stylist clothes; Models won’t be forced to wear anything they don’t feel comfortable with;

Photographers
Photographers will need to add their email addresses – IG contacts and if they are pro or amateurs in order to give a better idea to the organizers about who is coming at the event; Photographers need to share 3 pictures per model within a month after the photoshoot event through Flickr or directly with the model through emails;
Even if the photographers doesn’t want their photos on Social media they will need to share their pictures (at least 3 per model) with the models through private email; Photographers can take pictures of the model of their choosing;
Photographers are not required to take pictures of every single model at the photoshoot, only the ones they want;
Photographers can direct models on how to pose and if they have difficulties to direct a model they can ask advice to the other experienced photographers; If a makeup artist or a stylist join a photoshoot event, photographers are required to emphasis the makeup of the makeup artists and the clothes of the stylists on their pictures so the makeup artists and the stylists will get credits for it on social media; Photographers need to remind people the rules before the photoshoot starts and explain everyone’s priority for the photoshoot; Photographers are allowed to ask a participant to leave the photoshoot without refund if he or her has been disrespectful more than once during the photoshoot; Photographers are not obliged to take pictures of each models if they don’t feel like but they need to be welcoming and nice with all of them;

Artists profiles page
On this page everyone will be able to share their profile, adding their experience and some pictures of their portfolio.
To have access to this page each person will need to pay $2.50 membership per month. The page will allow each person to add their experience, their photos and some photos of their portfolio and also their contact for people to reach them out.

Licensing
Models who want to use a photographer’s pictures for a magazines from a Phosmora photoshoot will need to ask first the photographer if they can do it and get mutual agreements if only on social medias;

Sharing pictures on Social Medias
Before booking any photoshoot event, Phosmora will ask the participants if their pictures can be shared on social medias, if yes is their answer then everyone (photographers, muas, models and stylists) can share their pictures of that specific photoshoot.

Sharing pictures on magazines
If a model shares a photo on a magazine without telling the photographer of the photo, it is not fair but it is not Phosmora’s responsibility what the model does with the photo.
Any disagreement between models and photographers has to be solved between them without Phosmora involvement in the matter unless there is a disagreement during a photoshoot event in that case the organize of that photoshoot event will be responsible to help them to find a solution.

Stylists and Makeup artists
Makeup artists sometimes will join the photoshoot events and it is important that the photographers value and emphasis their makeup through the pictures; The stylists decides who can wear their clothes and how they want that their clothes look for visibility therefore only some models will wear their clothes and some others will need to bring their own ones;

Moodboards
Moodboard is shared before the photoshoot event on the event link;
Anyone can suggest a Moodboard for the photoshoot event by sending an email to the organizer of the event;

Complaints and Feedbacks
After each photohsoot event each participant will receive an email with the request of giving feedback about the event; The organizer of the event is the person who receives complaints and feedbacks after the photoshoot event;
The organizer replies to each complaint or feedback within 48 hours;
If the complaints or feedbacks are considered valid, the organizer will adjust the mistakes for the next photoshoot event;

Indemnity Agreement
Each participant will sign an indemnity agreement before signing in for the event where they will agree that Phosmora and the organizers won’t be responsible for any damages that the particpant will might get during the photoshoot event;
Phosmora kindly asks to each participant to be extremely careful during the photoshoot and not cause any damages to themselves and to the others;

Reporting disrespecful behavior
If the organizer repeatedly sees a disrespectful behavior from a participant at the event, will be authorized to ask the participant to leave the photoshoot and not getting any refund;
If any participant assists to any disrespectful behavior, he or her will be allowed to talk to the organizer and the organizer will take actions;

Cancellations or Refund
Once the organizers have booked the studio for the photoshoot participants can get the refund if they cancel within 72 hours before the photoshoot events, if they cancel after this time the refund won’t be possible;
You can cancel your membership anytime you want;

Payment method
Phosmora will accept payment through credit card and debit card;
The system we use is Stripe which is safe and secure for any transfer of money;

Summer Time
In Summer Time if the photoshoot will be done outdoor, all the participants will pay only for the organizational fees without the fees for the studio.

Flickr
Flickr is a platform where photographers and models share pictures and where everyone can download them;

Indemnity Agreement
Please read this carefully before signing in for the event.
This indemnity agreement is between Phosmora, Phosmora organizers and each participant of Phosmora photoshoot event.
All parties enter into this Indemnity Agreement to hold each other harmless form any suit, liability, claim,action or loss arising out of the below described incident, the parties agree as follows:

Liability, loss or damage
Indemnitor undertakes to indemnify indemnitee from any and all liability,loss or damage indemnitee may suffer as a result of claims, demands,costs or judgments against indemnitee arising from any physical damage to the person, loss of equipment or any other damage the participant can have during the photoshoot event.

Duration
The indemnity agreement is valid for each photoshoot event.
Each participant will need to be careful with their equipment and also for their own safety during the photoshoot events.
Phosmora also won’t take any responsibility for accidents that have been caused by a participant to another.

Taxes
Taxes will be charge also on top of Phosmora fees.

Privacy Policy
Phosmora collects personal information about you when you use the Phosmora Platform. Without it, we may not be able to provide all services requested.
This information includes:
Contact Information, Account, Profile Information. Such as your first name, last name, email address and profile photo.
Identity Verification and Payment Information. Such as images of your government issued ID (as permitted by applicable laws), your ID number or other verification information, bank account or payment account information. your payment card to complete a booking.
You can choose to provide us with additional personal information. This information may include:
Additional Profile Information. Such as gender, preferred language(s), city, and personal description. By providing us with personal information about others, you certify that you have permission to provide that information to Phosmora for the purposes described in this Privacy Policy, have shared the Phosmora Privacy Policy with them, and they have read and understood that it applies to them.
Other Information. Such as when you fill in a form for the photoshoot events, add information to your account, respond to feedbacks,communicate with some clients who can be interested in your profile.
When you use the Phosmora Platform and Payment Services, we automatically collect personal information.
This information may include:
Researches for Artists profile, photoshoot events bookings you have made, and other actions on the Phosmora Platform.
Log Data and Device Information. Such as details about how you’ve used the Phosmora Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the Phosmora Platform.
